5 Sep 2025: New Delhi, – The Delhi High Court has ordered a retired teacher to pay more money to his separated wife after 12 years. The court said that when a husband’s income goes up and living costs increase, the wife should get more support money.
Justice Swarana Kanta Sharma gave this important decision on Monday. A 60-year-old woman had asked the court to increase her monthly support money. She was not happy when a lower court said no to her request.
Marriage That Ended Early
The couple got married in April 1990. But after just two years, they started living separately. The wife said her husband hurt her physically and mentally. She also said he asked for dowry money.
In 2012, a family court told the husband to pay ₹10,000 every month to his wife. Six years later, in 2018, the woman asked for more money. She said her husband got a promotion from TGT teacher to PGT teacher and was earning more.
The husband retired in 2017 but kept working for two more years. The wife told the court that her father, who helped her with money, had died. She also had to spend a lot on medicines for arthritis and thyroid problems.
Court Changes Its Mind
The family court had said no to giving her more money in September last year. They said she had enough money in her bank account and fixed deposits.
But the High Court did not agree with this decision. The wife showed that in 2012, her husband was earning ₹28,000 per month. By the time of the new order, he was earning ₹40,000 per month.
“The rise in his income coupled with the significant increase in the cost of living constitutes a clear change in circumstances warranting enhancement of the amount of maintenance,” Justice Sharma said in bold and italic.
Health Card Must Be Restored
The 70-year-old husband said he could not pay more because he had retired. He said he had been paying support money for 32 years. Still, his wife did not want to live with him again or end the marriage legally.
Justice Sharma ordered the husband to add his wife’s name back to his CGHS health card. The judge said the wife has a right to use this card for medical treatment.
The court increased the monthly support from ₹10,000 to ₹14,000. The husband must pay all pending money within six weeks.
Both are now senior citizens living separately for almost 30 years but remain legally married.
