The Delhi High Court has upheld the conviction of a man for repeatedly raping his 15-year-old sister. The court said that compassion for a family cannot justify harm done to a child.
Court Rejects Appeal and Orders Compensation
The High Court agreed with the trial court that found the man guilty of rape and sexual assault under the POCSO Act. The court told the Delhi State Legal Services Authority to give 13 lakh rupees to the victim as compensation. The court also said the victim and her family should get counseling. The man had said he was not guilty, but the court did not agree with his reasons.
Victim and Family Asked for Release
The victim and her family came to court and asked for the man to be freed. The girl seemed nervous and said her brother did not make her pregnant. But the court said it did not matter if she agreed or not, because she was too young. The court said the girl had named her brother in her first complaint. The judges said that in such cases, families often try to protect adults instead of the child who is hurt.
Courts cannot mend what is broken at home. The message, however, must remain unambiguous. A childs bodily integrity is inviolable.
