The Delhi High Court dismissed Vikas Yadav's plea for extending his interim bail in the Nitish Katara murder case. The court said it lacks power to grant such relief after conviction, stating only the Supreme Court can use special powers in these matters.
Court Orders Immediate Surrender
Yadav must now surrender as his bail ended on Tuesday. The court said convicted persons can only get parole or furlough. It noted the Supreme Court gave Yadav interim bail using special powers, but the high court cannot do this. The judge said Yadav's request is not valid as his appeal was already rejected by both the high court and Supreme Court.
Background of the Case
Nitish Katara was killed in February 2002 over his alleged relationship with Yadav's sister. In 2008, Yadav and two others were found guilty. The high court later set a 30-year jail term for Yadav. In 2016, the Supreme Court changed it to 25 years without early release. Yadav's recent plea to the Supreme Court for bail extension was also rejected. The Delhi High Court on Tuesday dismissed a plea by Nitish Katara murder convict Vikas Yadav seeking extension of his interim bail saying it lacked the power to grant such relief after conviction. The court underlined that only the Supreme Court could exercise “extraordinary powers” under Article 142 of the Constitution in such matters….
Post-conviction, he is only entitled to parole or furlough. No provision empowers this Court to grant or extend interim bail.
