Supreme Court Overturns Madhya Pradesh High Court Ruling on Civil Judge

Supreme Court Allows High Court Appeal

The Supreme Court allowed the appeal filed by Madhya Pradesh High Court against its own division bench ruling. Advocate Ashwani Kumar Dubey, speaking for the high court, said a re-exam would be unconstitutional and impractical. He warned it could lead to many more court cases. Last year, the Supreme Court had stopped the high court order that halted recruitment for civil judge posts.

Changes in Madhya Pradesh Judicial Services Rules

The Madhya Pradesh Judicial Services Rules were changed on June 23, 2023. The new rules said candidates must have three years of practice to take the civil judge entry-level test. The high court first agreed with these new rules. But then two candidates who did not get selected asked for a review. They said they should be eligible under the new rules. This led to more legal problems. The high court then stopped the recruitment and said to remove candidates who did not meet the new rules.

A re-exam was unconstitutional, impractical and would floodgates of litigation.
