The Delhi High Court said the government has not implemented reservation for transgenders in public jobs as per a 2014 Supreme Court order. The court will now treat this matter as a public interest case. It gave the Delhi government 10 days to decide on giving benefits to transgenders in line with its 2021 notice.
Court Expands Scope of Petition
The court was hearing a case filed by a transgender person asking for reservation in court attendant jobs. The judges made this a bigger public interest case. They said the government has not followed Supreme Court orders to give reservations. The court asked the central and Delhi governments to join the case. It noted that even after the 2014 Supreme Court order, the government has not made proper rules for transgender jobs.
Directions to Delhi Government
In 2021, Delhi government said it would give transgenders 5 years extra age limit and 5% marks relaxation for government jobs. But it did not give reservation as the Supreme Court had ordered. The court said this was not enough. It told the Delhi government to decide in 10 days how to give these benefits to transgenders. If the government makes these changes, people will get one more month to apply for jobs. The court said this information should be told to everyone.
We are of prima facie opinion that for inclusion and for full and effective participation, the government ought to have taken some policy decision for providing reservation as already mandated in the NALSA judgment.
